$1 Trial Fair Use & Anti-Abuse Policy

1. Introduction and Legal Status
1.1 This $1 Trial Fair Use & Anti-Abuse Policy (the “Trial Policy”) governs access to, participation in, and use of the $1 promotional trial offered by Make Media Limited, a company incorporated in England and Wales (Company No. 15632662), trading as MakeUGC (the “Company”, “MakeUGC”, “we”,“us”, or “our”)
1.2 This Trial Policy forms an integral and binding part of the Company’s:
- Terms of Service
- Fair Use Policy
- Privacy Policy
- Any applicable Subscription or Pricing Terms
Together, the above documents constitute the entire agreement between the user and the Company in relation to the $1 Trial
1.3 By registering for, accessing, or paying for the $1 Trial, you:
- Confirm that you have read, understood, and agreed to this Trial Policy;
- Acknowledge that this Policy is legally binding; and
- Expressly consent to the charging, enforcement, monitoring, and penalty mechanisms described herein.
1.4 The purpose of this Trial Policy is to:
- Prevent fraud, abuse, circumvention, or exploitation of promotional pricing;
- Protect platform resources and commercial fairness; and
- Ensure the $1 Trial is used strictly as intended
2. Trial Eligibility and Scope
2.1 The $1 Trial is strictly limited to one (1) trial per individual or per legal entity, whether acting personally, professionally, or on behalf of a business.
2.2 The Trial may not be accessed, claimed, or used more than once:
- Directly or indirectly;
- Under the same or a different email address;
- Through another person, employee, contractor, or agent; or
- Via any technical or administrative workaround.
2.3 Trial access is:
- Promotional,
- Temporary, and
- Granted entirely at the Company’s discretion.
2.4 The Company reserves the right to:
- Refuse, restrict, suspend, or revoke Trial access at any time; and
- Determine eligibility using billing, identity, technical, behavioural, and fraud-prevention signals.
3. Prohibited Trial Abuse and Circumvention
3.1 Trial Abuse includes, without limitation, any attempt to create, access, or benefit from multiple Trial accounts, whether intentionally or negligently.
3.2 Prohibited conduct includes (non-exhaustive):
a) Creating or attempting to create more than one Trial account using
- The same or substantially similar name;
- Variations of the same individual or business identity;
b) Using the same or linked:
- Credit card or debit card;
- Payment processor account;
- Billing address;
- Payment location or country;
c) Allowing or enabling multiple users to access Trial benefits under:
- A shared payment method;
- A single billing instrument; or
- A controlled or related account structure;
d) Acting on behalf of, or in coordination with, the same individual, company, group, or organization to obtain multiple Trials;
e) Using technical measures to evade detection, including but not limited to:
- VPNs, proxies, or tunnelling services;
- IP masking or IP spoofing;
- Device fingerprint manipulation.
3.3 IP spoofing, masking, or deliberate obfuscation of technical identifiers shall be deemed a material breach of this Trial Policy and the Terms of Service.
4. Penalties, Immediate Charging, and Authorisation
4.1 Where the Company determines, acting reasonably, that Trial Abuse or circumvention has occurred or is likely to have occurred, the Company reserves the right to immediately charge the full monthly subscription fee applicable to the plan selected at signup (the “Penalty Charge”).
4.2 The Penalty Charge shall:
- Be equal to 100% of the applicable monthly subscription fee;
- Be processed immediately and without further notice; and
- Be charged to the payment method used for the $1 Trial.
4.3 By signing up for the $1 Trial, you expressly and irrevocably authorise MakeUGC to:
- Process such charges automatically;
- Treat Trial Abuse as acceptance of immediate conversion to a paid subscription; and
- Recover the Penalty Charge as a contractual debt.
4.4 Responsibility for preventing unauthorised or multiple Trial use under a shared payment method rests solely with the account holder.
4.5 No refunds, chargebacks, or reversals shall be issued in respect of Penalty Charges arising from Trial Abuse.
5. Enforcement Measures and Account Actions
5.1 In addition to charging the Penalty Charge, MakeUGC may, at its discretion and without liability, take one or more of the following actions:
- Immediate conversion of the account to a paid subscription;
- Suspension or termination of the Trial account;
- Suspension or termination of all associated or related accounts;
- Permanent revocation of promotional or trial eligibility;
- Internal flagging for fraud or abuse prevention purposes.
5.2 Enforcement actions may be taken without prior notice and shall not give rise to any entitlement to compensation or refund.
5.3 The Company may investigate suspected abuse using:
- Technical signals;
- Billing data;
- Device, IP, and location data;
- Behavioural and usage patterns, in accordance with applicable UK data protection law
6. Consent and Acknowledgement
6.1 By completing payment for the $1 Trial, you confirm and acknowledge that:
- You understand the Trial is limited to one use only;
- You will not attempt to create or benefit from multiple Trial accounts;
- You accept that IP spoofing or concealment is a breach; and
- You expressly agree to immediate charging of the full monthly fee if a violation is identified.
6.2 This consent is deemed given at the point of payment and is not conditional on continued use of the Services.
7. Relationship to Other Policies
7.1 This Trial Policy operates alongside and does not limit:
- The Terms of Service;
- Fair Use Policy;
- Privacy Policy;
- Any applicable Subscription or Enterprise Agreement.
7.2 In the event of any conflict, the Company’s determination shall prevail to the extent permitted by law.
8. Amendments and Discontinuation
8.1 The Company may amend, suspend, or withdraw the $1 Trial or this Trial Policy at any time.
8.2 Continued use of the Services after any amendment constitutes acceptance of the revised terms.
9. Governing Law and Jurisdiction
9.1 This Trial Policy and any dispute arising from it shall be governed by and construed in accordance with the laws of England and Wales.
9.2 The courts of England and Wales shall have exclusive jurisdiction.
